Colombia, La Guajira: British mining multinational is diverting vital water source for massive coal extraction, despite a Constitutional Court ruling for community consultation

For two years, mining company Cerrejón, alongside government bodies, have been disobeying a 2017 Colombian Constitutional court ruling against diverting a vital water source, the Bruno Stream.

The Constitutional Court declared a ruling (SU-698/17) in 2017, ordering that the diversion works be stopped, but this was not published in its entirety until earlier this year when the works were already nearly finished. 

Rather than consult with mining-affected communities about whether to remove a barrier, which is currently diverting the waters of the Bruno Stream towards an artificial streambed, as the court ordered, Carbones del Cerrejón (jointly owned by London-listed mining companies Anglo American, BHP and Glencore) and government bodies decided behind closed doors to allow the diversion to continue, preventing the water from being returned to its natural course.

This situation puts the fragile tropical dry forest ecosystem at high risk, as well as the communities who depend on the stream, as the Constitutional Court highlighted in its ruling.

The Bruno stream began to be diverted in 2016 with the aim of extracting approximately 35 million tonnes of coal from its bed. The stream is one of the main tributaries of the Ranchería river and several indigeneous Wayúu and Afro communities depend on its waters. In June 2016, three communities, supported by three Colombian NGOs, filed a legal action demanding that the works to divert the stream be stopped, due to a series of uncertainties and threats that the diversion would represent to this body of water, the fragile ecosystem of the tropical dry forest and the survival of communities living along the basin.

On June 6 this year, communities were finally called together where government bodies told them that the barrier would not be removed.

For this reason, Colombian Senators (Iván Cepeda, Jorge Enrique Robledo, Aida Avella, Feliciano Valencia and Alberto Castilla, and House Representative Alexander López), are calling a Regional Hearing on Tuesday 9 July in the Cultural Centre of Riohacha city from 8am to 4pm.

Over the last two days, affected communities and allied organisations have carried out verification visits of the Bruno Stream diversion works.

Guajira: Mantienen desvío del Arroyo Bruno a pesar de orden de Corte Constitucional de consultar a comunidades afectadas

El Cerrejón y las entidades del Gobierno desacatan sentencia de la Corte Constitucional que ordena incluir a las comunidades afectadas y a los expertos independientes en la mesa interinstitucional que debe resolver como medida provisional si retirar el tapón que actualmente desvía las aguas del Bruno hacia el cauce artificial. Ni las comunidades ni los expertos fueron tenidos en cuenta. La empresa y las entidades del gobierno decidieron a puerta cerrada no levantar el tapón, evitando así, que las aguas corran por su cauce natural. Situación que pone en alto riesgo el frágil ecosistema del bosque seco tropical y a las comunidades que dependen del arroyo, como lo señala la alta Corte en la misma sentencia. Solamente hasta el 6 de junio del 2019 las comunidades fueron convocadas para comunicarles la decisión de no retirar el tapón.

El Arroyo Bruno fue desviado para extraer cerca de 35 millones de toneladas de carbón de su lecho. El Bruno es uno de los principales tributarios del Río Ranchería y de sus aguas dependen varias comunidades Wayúu y afro que en el 2016 interpusieron una acción de tutela exigiendo que se detuvieran las obras ante las incertidumbres y las amenazas que representaría desviar este cuerpo de agua para el frágil ecosistema del bosque seco tropical y la supervivencia de las comunidades. La Corte Constitucional emitió la sentencia SU-698/17 en el 2017 ordenando detener las obras del desvío, pero fue publicada en su totalidad a principios del 2019 cuando las obras estaban prácticamente terminadas.

Por esta razón los senadores: Iván Cepeda, Jorge Enrique Robledo, Aida Avella, Feliciano Valencia, Alberto Castilla y el Representante a la Cámara Alexander López, convocan el martes  9 de julio en el Centro Cultural de Riohacha de 8 am a 4 pm a la Audiencia Regional en Riohacha

A su vez los días 7 y 8 de Julio se realizarán las visitas de verificación a las obras del desvío del Arroyo Bruno citadas por las comunidades afectadas y las organizaciones acompañantes.
