Communities around Glencore’s coal mining and transport operations in the Colombian departments of Cesar and Magdalena have written to the Colombian President and the Chief Executive of Glencore demanding effective consultation over a mine closure plan. An English translation of the text is below; below that, the Spanish original.

TO THE INTERNATIONAL AND NATIONAL COMMUNITY
By means of this letter we, the peasant, Afro-descendant, indigenous, victims’ communities and the trade unions of the mining corridor of the company GLENCORE and its subsidiary PRODECO in Cesar and Magdalena have formed an alliance in Colombia and we have united to jointly DENOUNCE at national and international level THE VIOLATION OF OUR RIGHT TO EFFECTIVE PARTICIPATION, ACCESS TO INFORMATION AND TRANSPARENCY IN THE CONSTRUCTION OF THE MINING CLOSURE PLAN of this company in view of its renunciation in 2020 of coal exploitation in this region after the year 2020, THE ACCESS TO INFORMATION AND TRANSPARENCY IN THE CONSTRUCTION OF THE MINING CLOSURE PLAN of this company in view of its renunciation in 2020 of coal exploitation in this region after 25 years of operations in the La Jagua and Calenturitas mines. Both the government and Glencore/Prodeco are systematically ignoring the serious environmental, social, labour and human rights impacts and damage caused by the mining activity of this company in our country.
In the face of this grave situation we jointly affirm:
- That the communities of the mining corridor recognised in the environmental licences are more than 20,000 thousand peasant, Afro-descendant, fishing and indigenous families who today find ourselves in a state of hunger, environmental degradation, living with serious respiratory and digestive diseases, without access to drinking water, with serious atmospheric pollution, displaced from our sacred and ancestral territories, and in a state of unprecedented chronic poverty caused by the inadequate exploitation that this company carried out in these two mines and the insufficient social and environmental measures it took during its operations.
- That the coal mining operation carried out by Prodeco/ Glencore in Colombia has caused serious environmental and social impacts and damage to our territory, air, rivers and coasts. We denounce that to date there have been NO independent studies on these cumulative impacts and damages, nor has there been any public accountability on the company’s compliance with due diligence in the fulfilment of the social and environmental obligations contained in the environmental licenses of these two mines during these more than 25 years. We denounce that to date we have NOT been consulted, nor have we had access to information and transparency, let alone spaces for participation in this closure plan that directly affects us. Furthermore, in the face of the serious pandemic and the virtualisation of spaces for dialogue, we have seen how our spaces for environmental participation have been drastically reduced, and in the face of the construction of a closure plan with this company and the obligation they have to consult us, we do NOT have even the minimum access to sufficient digital media to be able to participate effectively.
- That the workers and contractors of the company Prodeco/Glencore in Colombia at the Calenturitas and La Jagua mines have suffered in the last two years what we call: “a labour massacre” given the massive dismissal of more than 1,200 workers without guarantees.We also denounce that more than 5,000 contractors of service companies have been dismissed, generating a serious situation of unemployment in the area, hunger and systematically violating our labour rights. We denounce that this company did not respect due diligence, nor did it implement the appropriate legal procedures to carry out a progressive labour disengagement process that would guarantee human rights before the closure of its operations in this area of Colombia.
- That during these years the company Prodeco/Glencore has been investigated and denounced for its links with armed actors and its relationship with the armed conflict and violations of human rights in relation to the operation of these two mines, and to date we do not know what measures and obligations will guarantee truth, justice and reparation for the victims in view of the plan to close its operations in this area. We denounce that the company Prodeco/Glencore has claimed that they have consulted widely on policies such as the Human Rights policy carried out in 2019, but this is NOT true, given that to date all of us, the communities of the mining corridor, trade unions and victims, have not had a DUE process of broad and participatory consultation on their instruments of respect for human rights.
For all these reasons WE UNITE because WE WANT TO BE HEARD AND WE DEMAND:
- We demand that the company GLENCORE and its subsidiary PRODECO in Colombia make public the CLOSURE PLAN of its operations in the Calenturitas and La Jagua mines before the legal handover of these mines to the Colombian State, in order to inform the communities of the mining corridor, the victims, the trade unions, all Colombian government authorities and civil society in general of the measures it proposes to adopt to comply with its environmental and social obligations to this region.
- That a TABLE OF DIALOGUE be opened with the communities of the mining corridor, the victims and the trade unions, with the Colombian government as director and guarantor, the Glencore/Prodeco company as responsible and civil society as overseer; that guarantees our rights to effective participation, transparency, access to information and that we are given sufficient guarantees of access to digital media for decision-making on the social, environmental and labour measures that this company must implement within the mining closure plan, guaranteeing due diligence and respect for our human rights.
- We ask the company GLENCORE and its subsidiary PRODECO to adopt special measures with regard to the victims of the armed conflict within the plan to close its operations in this region of Colombia, given the investigations and denunciations in which it is involved and the need for a public expression and obligation of this company to respond in the event that the Colombian justice system so determines, in order to guarantee truth, justice, reparation and measures of non-repetition for the victims of this region.
- That the Colombian government, together with the communities, trade unions, victims and civil society in general, should develop the measures that Glencore/Prodeco should adopt in its mine closure plan to address the environmental, social and economic impacts and damage caused by its mining operations for more than 25 years, and if necessary, order the company to pay for independent technical studies carried out by experts under a mechanism of impartiality with international and national oversight.
We deeply believe in the need for a dialogue with guarantees so that you, Mr. President, from the Ministry of Mines and Energy and the Ministry of Environment, guarantee an adequate energy transition in Colombia in this area so affected by climate change and create the necessary spaces to demand sufficient measures for the company Glencore and its subsidiary Prodeco in Colombia to close its operations respecting human rights and due diligence, protecting and restoring the environment, guaranteeing the labour rights of its workers/contractors, and protecting the rights of the victims of the conflict after 25 years of exploiting coal in our country.
As Afro-descendant, indigenous, peasant and fishing communities, victims of the armed conflict and trade unions of Cesar and Magdalena; supported by environmental and human rights organisations at the national and international level we remain attentive to your response.

A LA COMUNIDAD INTERNACIONAL Y NACIONAL
Por medio de la presente carta nosotros las comunidades campesinas, afrodescendientes, indígenas, de victimas y los sindicatos del corredor minero de la empresa GLENCORE y su filial PRODECO en Cesar y el Magdalena hemos realizado una alianza en Colombia y nos hemos unido para conjuntamente DENUNCIAR a nivel Nacional e Internacional LA VIOLACIÓN A NUESTRO DERECHO A LA PARTICIPACIÓN EFECTIVA, EL ACCESO A LA INFORMACIÓN Y LA TRANSPARENCIA EN LA CONSTRUCCIÓN DEL PLAN DE CIERRE MINERO de esta empresa ante su renuncia en 2020 a la explotacion de carbón en esta región despues de 25 años de operaciones en la mina la Jagua y Calenturitas. Desconociéndose tanto por su gobierno cómo por la empresa Glencore/Prodeco de forma sistemática los graves impactos y daños ambientales, sociales, laborales y en derechos humanos que ha dejado la actividad minera de esta empresa en nuestro país.
Ante esta grave situación conjuntamente afirmamos:
- Que las comunidades del corredor minero reconocidas en las licencias ambientales somos más de 20.000 mil familias campesinas, afrodescendientes, pescadoras e indígenas quienes hoy nos encontramos en un estado de hambre, degradación ambiental, viviendo enfermedades respiratorias y digestivas graves, sin acceso al agua potable, con una grave contaminación atmosférica, desplazados de nuestros territorios sagrados y ancestrales, y en un estado de pobreza crónica sin precedentes ocasionada por las inadecuadas explotaciones que esta empresa realizó de estas dos minas y las insuficientes medidas sociales y ambientales que tomó durante sus operaciones.
- Que la operación minera de carbón adelantada por la empresa Prodeco/ Glencore en Colombia ocasionó graves impactos y daños ambientales y sociales en nuestro territorio, aire, ríos y costas. Denunciamos que hasta la fecha NO se han realizado estudios independientes sobre estos impactos y daños acumulativos, ni tampoco una rendición de cuentas pública sobre el cumplimiento por parte de esta empresa de la debida diligencia en el cumplimiento de las obligaciones sociales y ambientales contenidas en las licencias ambientales de estas dos minas durante estos más de 25 años. Denunciamos que hasta la fecha NO hemos sido consultados, ni hemos tenido acceso a la información y transparencia, ni mucho menos contamos con espacios de participación sobre este plan de cierre que nos afecta directamente. Además, ante la grave pandemia y la virtualización de los espacios de diálogo, hemos visto cómo se han reducido de forma drástica nuestros espacios de participación ambiental y ante la construcción de un plan de cierre con esta empresa y la obligación que tienen de consultarnos NO contamos ni siquiera con el acceso mínimo a los medios digitales suficientes para poder participar de forma efectiva.
- Que los trabajadores y contratistas de la empresa Prodeco/Glencore en Colombia de las minas Calenturitas y la Jagua hemos sufrido estos dos últimos años lo que llamamos: “una masacre laboral” dado el despido masivo y sin garantías de más de 1.200 trabajadores por medio del llamado “retiro voluntario” que en realidad ha sido un despido indirecto que no garantiza los derechos mínimos laborales de los trabajadores, y también denunciamos que se han despedido más de 5.000 contratistas de empresas prestadoras de servicios generando una grave situación de desempleo en la zona, hambre y violando de forma sistemática nuestros derechos laborales. Denunciamos que esta empresa no respetó la debida diligencia, ni implementó los procedimientos legales adecuados para hacer un proceso de desvinculación laboral progresivo y garante de los derechos humanos ante el cierre de sus operaciones en esta zona de Colombia.
- Que durante estos años la empresa Prodeco/Glencore ha estado investigada y denunciada por su vinculación con actores armados y su relación con el conflicto armado y violaciones a los Derechos Humanos frente a la operación de estas dos minas, y hasta la fecha no conocemos cuáles serán las medidas y obligaciones que garanticen la verdad, justicia y reparación de las víctimas ante el plan de cierre de sus operaciones en esta zona. Denunciamos que la empresa Prodeco/Glencore ha afirmado que han consultado ampliamente políticas cómo la de Derechos Humanos realizada en 2019 pero esto NO es cierto, dado que hasta la fecha todos nosotros las comunidades del corredor minero, sindicatos y víctimas no hemos tenido un DEBIDO proceso de consulta amplia y participativa sobre sus instrumentos de respeto a los derechos humanos.
Por todas estas razones NOS UNIMOS porque QUEREMOS SER ESCUCHADOS Y EXIGIMOS:
- Exigimos que la empresa GLENCORE y su filial PRODECO en Colombia haga público el PLAN DE CIERRE de sus operaciones en las minas calenturitas y la Jagua antes de la entrega legal de estas minas al Estado Colombiano, con el fin de dar a conocer tanto a las comunidades del corredor minero, las víctimas, los sindicatos, a todas las autoridades del gobierno Colombiano y a la sociedad civil en general las medidas que propone adoptar para el cumplimento de las obligaciones ambientales y sociales con esta región.
- Que se abra una MESA DE DIÁLOGO con las comunidades del corredor minero, las víctimas y los sindicatos con el gobierno Colombiano cómo director y garante, la empresa Glencore/Prodeco como responsable y la sociedad civil cómo veedora; que garantice nuestros derechos a la participación efectiva, la transparencia, el acceso a la información y se nos den la garantías suficientes de acceso a los medios digitales para la toma de decisiones sobre las medidas sociales, ambientales y laborales que esta empresa debe implementar dentro del plan de cierre minero garantizando la debida diligencia y el respeto a nuestros derechos humanos.
- Solicitamos a la empresa GLENCORE y su filial PRODECO que adopte medidas especiales frente a las víctimas del conflicto armado dentro del plan de cierre de sus operaciones en esta región de Colombia, dado las investigaciones y denuncias en las que se encuentra vinculada y la necesidad que exista una expresión y obligación pública de esta empresa de responder en caso de que la justicia Colombiana así lo determine, con el fin de garantizar la verdad, la justicia, la reparación y las medidas de NO repetición a las víctimas de esta región.
- Que el Gobierno Colombiano construya junto con las comunidades, sindicatos, víctimas y la sociedad civil en general las medidas que esta empresa Glencore/Prodeco debe adoptar en su plan de cierre minero frente a los impactos y daños ambientales, sociales y económicos que han producido durante sus operaciones mineras por más de 25 años, y si es necesario ordene que esta empresa pague estudios técnicos independientes y realizados por expertos bajo un mecanismo de imparcialidad que cuente con veeduría internacional y nacional.
Creemos profundamente en la necesidad de un diálogo con garantías para que usted Señor Presidente desde el Ministerio de Minas y Energía y el Ministerio de Medio Ambiente, garantice una adecuada transición energética en Colombia en esta zona tan afectada por el cambio climático y cree los espacios necesarios para exigir las medidas suficientes para que la empresa Glencore y su filial Prodeco en Colombia cierre sus operaciones respetando los derechos humanos y la debida diligencia, protegiendo y restaurando el medio ambiente, garantizando los derechos laborales de sus trabajadores/contratistas, y protegiendo los derechos de la víctimas del conflicto tras 25 años de explotar carbón en nuestro país.
Como comunidades afrodescendientes, indígenas, campesinas, de pescadores, víctimas del conflicto armado y sindicatos del Cesar y Magdalena; apoyados por organizaciones ambientalistas y de derechos humanos a nivel nacional e internacional quedamos atentos a su respuesta.
